ReLend, LLC – Privacy Policy

This Privacy Policy describes ReLend LLC’s policies on the collection, use and disclosure of information about you that we may collect on or through the ReLend App. This Privacy Policy also explains your legal rights with respect to this information.

By using the ReLend App, you consent to our collection, use and disclosure of information about you as described in this Privacy Policy.  Capitalized terms not defined in this Privacy Policy are defined in the Terms at re-lend.com/termsandconditions.

1.) Information We Collect

ReLend collects and stores certain personally identifiable information about you, including information that can identify with you or is reasonably capable of being associated with you (“Personal Information”). Examples of Personal Information that ReLend collects include but are not limited to:

  • User Account Information. We require that you provide certain Personal Information when you register an account in order to rent items, lend items, rent services, or lend services through the ReLend App.  Specifically, we collect your first and last name, phone number, email address and your mailing address in order to create and administer your User account. We also gather information to ease your renting or lending process, such as information about the task you are looking for, the date, and location of the task. 
  • Billing Data. This includes payment information (such as a credit or debit card number), expiration date, and security code to process your payments, add funds, or withdraw funds from your account.
  • Identity Information. If you are a Service Provider, we may collect information such as your date of birth, mailing address, and social security number if applicable, and to the extent allowed by law. This information is needed to verify your identity and conduct a background check. ReLend will never store SSN provided for background check purposes as this information will only be passed to Checkr (a third party company) for the sole purpose of conducting the background check. This is a necessary step to show Renters that a Service Provider is safe and reliable. 
  • Transactions.  If you initiate a transaction through the ReLend App, we will collect and store information you provide associated with your transaction, such as your name, phone number, address, email, and payment information, as well as any other information you provide relating to the transaction or request, in order to process your transaction, send you communications related to the transaction, and to facilitate future transactions.

2.) Information Gathered Automatically

We automatically collect certain information when you use the ReLend App. The categories of information we automatically collect are as follows:

  • Device Data. You may access the ReLend App through different devices (e.g., your mobile phone, tablet, or other internet connected device). We may use information from and about each device to view the geographic locations from which users interact with the ReLend App for security and fraud prevention purposes. Any use of IP-masking technologies or similar technologies may render portions of the ReLend Platform unavailable and are forbidden on the ReLend Platform.  We may also collect and store information that your device may provide to us in connection with your use of the ReLend App, such as your browser type, type of computer or mobile device, browser language, IP address, WiFi information such as SSID, mobile carrier, phone number, unique device identifier, advertising identifier, location (including geolocation, beacon based location, and GPS location), and requested and referring URLs and mobile applications. We may also receive and store your location whenever our mobile applications are running, including when running in the background, if you enable our mobile apps to access such information in the course of using the ReLend App.
  • Location Data. This includes location data (such as location derived from an IP address), and, with your consent, precise location data. We will never share your current location with other users. This information is simply needed to connect you to other users of the ReLend App in your area.

3.) ReLend’s Use of Information

Our purposes for collecting, storing and using Personal Information include:

  • To connect you with other registered users near you in order to allow for the posting of, selection of, completion of, and payment for items and services.
  • To prevent fraud and to provide a safe platform for Renters and Lenders or Service Providers to connect and conduct business.
  • To conduct identification and criminal background checks, in order to ensure the safety of the ReLend App given that Lenders and Service Providers often interact directly with Renters.
  • To contact you (via email, SMS, push notifications) and to deliver transactional information.
  • To provide customer support.
  • To improve the quality of the ReLend App.
  • To track your usage of the ReLend App.
  • To enforce our Terms.
  • To comply with legal obligations.
  • To make your profile visible on the ReLend App. This includes information about you and your business, photographs, information about your expertise, skills, hourly pay rates, and reviews provided by other users that have rented from you. The information in your profile may be visible to all users.

4.)  How We Share Information

(a) If another company acquires ReLend LLC, or all or substantially all our assets, we may transfer your Personal Information to the acquirer without your prior consent.  That company will possess the same information, and will collect, use, and disclose the information only as described in this Privacy Policy, unless you are otherwise notified following the acquisition.

(b)  We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure: (a) is reasonably necessary to comply with legal or law enforcement processes, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process or law enforcement request; (b) is helpful to prevent, investigate, or identify possible wrongdoing in connection with the ReLend App; or (c) protects our rights, reputation, property, or that of our users, affiliates, or the public. If you flag or otherwise complain to us about content through the ReLend App, we may share the substance of your complaint with the contributor of that content in order to provide an opportunity for the contributor to respond.

(c)  The ReLend App may provide links to third party-controlled websites, such as another business’s URL. Except as set forth herein, we do not share your personal information with the linked businesses, and we are not responsible for their privacy practices.  You should read the privacy policies available on any website that you link to through the ReLend App.

(d) ReLend App relies on third party service providers to support and assist in the provision of services, such as providing background checks, processing payments and confirming user information.  ReLend will share information from or about you with these third party service providers so that they can perform their services at our request.  ReLend will share your Personal Information with third party service providers subject to obligations consistent with this Privacy Policy, and on the condition that your Personal Information is used only on behalf of ReLend and pursuant to our instructions. Our third party service providers may likewise share information with us that they obtain from or about you in connection with providing their services.

(e) Phone Numbers are not shared or sold to any third parties or affiliates for their marketing purposes.

5.)  Account Termination and Data Retention

You may closer your User account by contacting us at support@Re-Lend.com. Even after you terminate your User account, we may retain information about you for the purposes authorized under this Privacy Policy unless prohibited by law. For example, we may retain information to prevent or investigate possible wrongdoing in connection with the ReLend App, or to comply with legal obligations. We may also maintain residual copies of your personal information in our backup systems. 

6.)  Security. 

We implement safeguards to protect the Personal Information that we collect and store.  However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the security of your Personal Information.

7.)  Children.

The ReLend App is not directed to children under 13. ReLend does not knowingly collect personal information from children under 13.  If you become aware that a child under 13 has provided us with personal information without parental consent, please contact us at support@re-lend.com.  We will take immediate action to remove the information and terminate the child’s User account.

8.)  Changes to this Privacy Policy

We may change or update this Privacy Policy from time to time.  If we make material changes we will notify you by email and post a notice on the ReLend App.  By continuing to use the ReLend App after receipt of such notice, you consent to the terms of such updated Privacy Policy.  The most current version of the Privacy Policy available on the ReLend App will govern our collection, use and disclosure of information.   

9.)  YOUR CALIFORNIA PRIVACY RIGHTS

Under the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (“CCPA”), California residents have certain rights around ReLend’s collection, use and disclosure of their Personal Information.  ReLend does not sell your Personal Information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. ReLend does not offer financial incentives associated with our collection, use or disclosure of your Personal Information.

As of January 1, 2023 you have the right to opt-out of sharing your Personal Information with third parties for the purposes of targeted behavioral advertising by contacting us at support@re-lend.com. ReLend collects various categories of Personal Information when you use the ReLend App, including identifiers, internet or other electronic network or device activity information and geolocation data. A more detailed description of the information ReLend collects and how we use it is provided above in Sections 1, 2, 3 and 4.  

If you are a resident of California, you have the right to know what Personal Information has been collected about you, and to access that information. You also have the right to request deletion of your Personal Information, though exceptions under the CCPA may allow ReLend to retain and use certain Personal Information notwithstanding your deletion request. 

As of January 1, 2023 you have the right to request correction of inaccurate Personal Information and to request to limit disclosure or use of your sensitive Personal Information. An agent may submit a request on your behalf, but you must verify that your agent is authorized to do so.  You can learn more about how to submit a data rights request by contacting us at support@re-lend.com

We will not discriminate against you for exercising your rights under the CCPA.  ReLend does not knowingly sell or share the personal information of consumers under 16 years of age.  Separate from the CCPA, California’s Shine the Light law gives California residents the right to ask companies what Personal Information they share with third parties for those third parties’ direct marketing purposes. We do not disclose your Personal Information to third parties for the purpose of directly marketing their goods or services to you unless you request such disclosure. 10.)   YOUR NEVADA PRIVACY RIGHTS

Nevada law (SB 220) requires website operators to provide a way for Nevada consumers to opt-out of the sale of certain information that the website operator may collect about them. ReLend does not sell your Personal Information to third parties as defined in Nevada law, and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law.  11.)  YOUR VIRGINIA PRIVACY RIGHTS

Under Virginia’s Consumer Data Protection Act (“CDPA”), Virginia residents have certain rights around ReLend’s collection, use and disclosure of their personal data.  ReLend does not sell your personal data and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law.  ReLend does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects.  ReLend may engage in “targeted advertising” as that term is defined in the CDPA, and you have the right to opt-out of targeted advertising by contacting us at support@re-lend.com.

12.)   YOUR COLORADO PRIVACY RIGHTS (Effective July 1, 2023)

Under Colorado’s Consumer Privacy Act (“CPA”), which goes into effect July 1, 2023, Colorado residents have certain rights around ReLend’s collection, use and disclosure of their personal data.  ReLend does not sell your personal data and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. ReLend does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects.  ReLend may engage in “targeted advertising” as that term is defined in the CPA. As of July 1, 2023 you will have the right to opt-out of targeted advertising by contacting us at support@re-lend.com.
